The Anderson County Clerk, Mark Staples, keeps civil court records for cases handled in the County Court and County Court at Law. This office handles civil suits up to $200,000, misdemeanor criminal cases, probate matters, and all real property records. The office has been in continuous operation since Anderson County was organized in 1846. You can visit them at the courthouse on North Church Street in Palestine.

Civil case indexes are available through the iDocket portal going back to 1982. Probate records in the system go all the way back to 1846. The online index lets you search by party name, case number, date range, case type, or attorney name. Keep in mind the index only shows basic case information. Document images are not available online. You need to visit in person or request certified copies to see the actual court files.

Anderson County District Clerk

The District Clerk, Teresia Coker, handles district court civil cases in Anderson County. These are the larger cases: civil suits over $200,000, family law matters, felony criminal cases, and juvenile proceedings. The District Clerk's office is also on the first floor of the courthouse at 500 N. Church Street, Room 18. Anderson County has four district courts: the 3rd, 87th, 349th, and 369th District Courts. Each handles a specific mix of civil, criminal, and family cases.

Since January 1, 2020, the District Clerk's office does not accept checks. Accepted payment forms are debit card, credit card, money order, and cash.

Filing fees in Anderson County are set by state statute. The County Clerk charges $26 for recording the first page of a document and $4 for each additional page. Standard copies cost $1 per page. Certified copies of court documents cost $5 per document plus $1 per page. If you need an official name search, the fee is $5 per name.

Property recording fees also apply in civil matters where real estate is involved. Recording a deed or lien costs $26 for the first page and $4 per page after that. There is also a $0.25 charge for each additional name beyond five that must be indexed on a document.

If you cannot pay court costs, Texas law provides an option. Under Texas Rule of Civil Procedure 145, you can file a Statement of Inability to Afford Payment of Court Costs. You must show financial hardship to qualify. Forms are available at the courthouse or through txcourts.gov.
